Terms of Service

Welcome to Bayt Muslim. These Terms of Service ("Terms") are a binding agreement between you and Bayti, LLC ("Bayt Muslim," "we," "us"), which operates the Bayt Muslim website, mobile apps, and related services (the "Platform"). By creating an account, browsing, listing, or booking, you agree to these Terms.
1. What Bayt Muslim is
Bayt Muslim is a marketplace that connects travelers ("Guests") with people offering faith-aligned stays, retreats, experiences, and home-cooked ("Bayti") meals ("Hosts"). We are not the owner, operator, or provider of any listing. The contract for any booking is directly between the Guest and the Host. We provide the technology, payment facilitation, and trust tools that make bookings possible.
2. Eligibility & accounts
You must be at least 18 and able to form a binding contract to use the Platform. You are responsible for the activity on your account and for keeping your login secure. Provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms.
3. Bookings & payments
Prices are set by Hosts and shown before you book. When you book, you authorize payment of the listing price plus the Bayt Muslim service fee. Payments are processed by our payment provider, Stripe; Hosts receive payouts via Stripe after a booking is confirmed and our payout conditions are met. Bayt Muslim charges a service fee on bookings (currently a percentage of the booking total, disclosed at checkout). Fees may change with notice. Bayt Muslim does not collect or remit any taxes. Any taxes that apply to a booking (such as sales, occupancy, or tourist tax) are included by the Host in the listing price, and Hosts are solely responsible for collecting and remitting them.
4. Cancellations & refunds
Each listing may display a cancellation policy. Unless stated otherwise, eligible refunds are returned to your original payment method, less non-refundable fees where applicable. If a Host cancels a confirmed booking, you are entitled to a refund of amounts paid for that booking. We may mediate disputes but are not obligated to issue refunds beyond the applicable policy.
5. Faith Standards & listing content
Listings are presented with Faith Standards badges (for example, family-verified, alcohol-free, prayer-equipped). Hosts are responsible for the accuracy of their listings and badges. Bayt Muslim may review, approve, decline, or remove listings, but does not guarantee that any listing meets every standard. See our Faith Standards.
6. Host obligations
Hosts must have the right to offer what they list, describe it accurately, honor confirmed bookings, comply with applicable laws (including taxes, permits, and safety requirements), and treat Guests with respect. Hosts are independent and are not employees or agents of Bayt Muslim.
7. Guest obligations
Guests must use listings respectfully and as described, follow Host rules, and leave spaces in good condition. You are responsible for damage you cause.
8. Acceptable use
Do not use the Platform for anything unlawful, fraudulent, discriminatory, or harmful; do not circumvent fees or take bookings off-platform; do not post false, infringing, or abusive content; do not interfere with the Platform's operation or security.
9. Reviews & content license
You may post reviews and content. You retain ownership but grant Bayt Muslim a non-exclusive, worldwide, royalty-free license to host and display that content to operate and promote the Platform. Content must be honest and lawful.
10. Disclaimers
The Platform is provided "as is." We do not guarantee any listing, Host, or Guest, and we do not control the quality, safety, or legality of what is offered. To the maximum extent permitted by law, we disclaim all warranties.
11. Limitation of liability
To the maximum extent permitted by law, Bayt Muslim is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the greater of the fees we earned on the booking at issue or US$100.
12. Indemnification
You agree to indemnify and hold Bayt Muslim harmless from claims arising out of your listings, bookings, content, or violation of these Terms or the law.
13. Privacy
Our Privacy Policy explains how we handle your information and is incorporated into these Terms by reference.
14. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
15. Dispute resolution — arbitration & class-action waiver (draft — attorney review required)
Except where prohibited by law, you and Bayt Muslim agree to resolve disputes through binding individual arbitration rather than in court, and to waive any right to a jury trial and to participate in a class or representative action. Either party may still bring a qualifying claim in small-claims court. This clause must be finalized by counsel to ensure it is enforceable in your jurisdiction; until then, disputes are resolved in the state or federal courts located in Florida.
16. Miscellaneous
If any provision of these Terms is held unenforceable, the rest remain in effect (severability). These Terms — together with the Privacy Policy and the Host and Guest Agreements — are the entire agreement between you and Bayt Muslim. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Bayt Muslim may assign them. We may send you notices by email or in-app. Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure). You consent to receive these Terms and related agreements, disclosures, and notices electronically, and you agree that your electronic acceptance — such as clicking "agree" or completing a booking — has the same effect as a handwritten signature.
17. Changes
We may update these Terms. Material changes will be posted here with a new "Last updated" date and, where appropriate, additional notice. Continued use after changes means you accept them.
